Well I arrived at this video by accident as I was investigating financial investment trusts but I've learned about another type of trust that I've been pondering for a while as I need to put something tangible in place before its too late, even just a simple will. I was unfortunately mesmerized throughout by the beautiful styling of this ladies hair, pure class. Hopefully I'll not be sued for saying that as I'll have no assets to put in my trust if that happens 😢

Yes, in fact, putting certain assets in a separate trust is a common strategy for many clients of ours. The strategy is highly dependent on multiple factors, however, so it is always important to get the right advice!
We tried this and a greedy trustee grantee beneficiary changed it with a dysmorphic criminal attorney to steal our home and put us on the street. Your advice about putting the trust as the beneficiary of a 401(k) is bad news. You realize that the 401(k) would have to be emptied and 100% of the balance would become ordinary income, right? Let's say the 401(k) balance is $1M. The guy dies and the $1M is now inside the trust. $1M in ordinary income is brought in and taxed accordingly. As a Financial Advisor for 20 years, I have been correcting clients who's lawyers told them to leave the trust as the beneficiary. But if left to his wife (as listed beneficiary), she could open an IRA and all $1M comes into her IRA without a penny of taxes in the moment.
If a lawyer understands the risks and benefits and explains them to their client, and they choose to do it anyway (and by the way, many do) then it is not bad news. Also, it is possible to draft a trust as a qualified designated beneficiary under the IRS tax rules. This requires an advanced understanding of the LAW. While I appreciate you pointing these things out, this is a typical response by a financial advisor who doesn't understand all the legal issues involved in this decision. I know some lawyers don't understand how this works, either. If you are a lawyer and you don't understand it, you should. If you are a financial advisor and you don't understand it, you should. If you are giving advice without this understanding, you are most likely committing some form of malpractice.

What the trust company will do is be really nice to the matriarch of the family and visit her. Than when she is on pain meds, they will offer to give control to a local college and the heirs get a pathetic payment plus they have to pay taxes on it.

I took notes, thank you for clarity on the basics of Trusts! No probate! I now can explain exactly what I want my rule book to say with the help of my lawyer. I am loving the idea of TRUST automatically shifting control for me and my spouse if we get sick or upon death. God bless you!
Trusts can be the cause of long probate ordeals. For instance, we've seen corporate trustees who get fired, replaced, or reported, and who then file in probate and drag the couple or individual who set up the trust through probate until they die or are rendered insolvent. By filing litigation pretending to have concern for the couple, the corp trustee ended all possibility of being investigated by the CFPB, SEC, FDIC, FINRA, Senate committees and ALL government agencies since NONE will investigate those in litigation. In several such cases we know about, attorneys drained as much as 25% of estates and got guardians or conservators involved to revoke all POAs among family, so the family had no ability to make decisions over how much money was spent or who was hired to do home maintenance. We can see trustee quarterly statements paying out $250 each time a lawn was mowed whereas the family was being charged only $50 for the lawn when they had the right to hire someone. And you're wrong if you think the $250 crew did more or did it better.
